Monthly Board Meeting
April 10th, 2012
Meeting was called to order by Chairman, Al House at 6:00 p.m.
Roll Call: Charly Ray Supervisor, present; Larry Nelson Supervisor, present; Wanda Hyde Clerk, present; Carol DeMars Treasurer, present and Al House Chairman, present. Others present were: David Hyde, Mike Yonan, Jan Victorson, Deb Gierczic, Gary Van Dyke, Jeremy Koehl, Sue Jenicek, Don Jenicek, Rita Sharp and Bob Sharp.
Motion to approve the minutes of March 13, 2012 was made by Charly Ray seconded by Larry Nelson. Motion carried.
Treasurer Report was given by Carol DeMars: Checking $54,486.56; Regular Savings $101,821.97; Tax levies $52,777.72; Equipment Fund $4,321.61 and Room Tax $2,200.51.
Motion to approve and pay bills in the amount of $145,106.44 was made by Charly Ray seconded by Larry Nelson. Motion carried.
Citizens Concerns and Comments.
Jeremy Koehl permit to rent an apartment in the lowest level of his home as a short term rental was brought forward by request.
Motion to approve and sign Jeremy Koehl’s permit to rent an apartment in his home on a short term basis was made by Charly Ray seconded by Larry Nelson. Motion carried.
Jan Victorson, Emergency Management Coordinator spoke regarding chain of command during an emergency; emergency preparedness; and structure for Town of Bayview.
Road Report –
Mike Yonan, Road Supervisor presented prices for road work: Washington Ave, wedge and overlay ½ mile $82,364.00; Friendly Valley $132,000.00; Frostman Road $34,155.00 road work, ditching, clearing and install culvert. He also reported that they have finished building the broom and have been using it.
Frost is still in the roads, road bans will stay in place at this time.
Road Tour has been set for April 24th, 2012 at 8:00 a.m.
Motion was made by Larry Nelson seconded by Charly Ray to adjourn for the Annual Town Meeting.
Motion carried.
Motion to reconvene the regular Town Board meeting was made by Larry Nelson seconded by Charly Ray. Motion carried.
Motion to approve the purchase of cutter in the amount of $10,600 was made by Charly Ray seconded by Larry Nelson. Motion carried.
Trees/Smith Fire Lane was presented by Charly Ray. He would like to see the town plant approximately 340 trees on the North side of East/West section of Smith Fire Lane. Larry Nelson would check with County to see if we could get trees donated and Charly Ray will have costs at next meeting.
Park Ordinance 02-79 has been redone by the Parks Committee. Motion was made by Larry Nelson seconded by Charly Ray to make changes and bring back to the May meeting for approval. Motion carried.
Changes: 1st page C. delete the words the lake bordering and 3rd page P. add without first obtaining a written permit from Bayview Town Board.
Motion to approve and set the 2012 Annual Picnic date at 9/9/2012 was made by Larry Nelson seconded by Charly Ray. Motion carried.
The following preamble and resolutions were presented by Supervisor Charly Ray and were read to the meeting.
By the provisions of Sec.24.66 of the Wisconsin Statutes, all municipalities may borrow money for such purposes in the manner prescribed, and,
By the provisions of chapter 24 of the Wisconsin Statutes, the Board of Commissioners of Public Lands of Wisconsin is authorized to make loans from the State Trust Funds to municipalities for such purposes. (Municipality as defined by Sec. 24.60(2) of the Wisconsin Statutes means a town),
THEREFORE, BE IT RESOLVED, that the Town of Bayview, in the County of Bayfield, Wisconsin, borrow from the Trust Funds of the State of Wisconsin the sum of One Hundred Nine Thousand Two Hundred Thirty Seven and 08/100 Dollars ($109,237.08) for the purpose of refinancing outstanding debt and for no other purpose.
The loan is to be payable within 5 years from the 15th day of March preceding the date the loan is made. The loan will be repaid in annual installments with interest at the rate of 2.75 percent per annum from the date of making the loan to the 15th day of March next and thereafter annually as provided by law.
RESOLVED FURTHER, that there shall be raised and there is levied upon all taxable property, with the Town of Bayview, in the County of Bayfield, Wisconsin, a direct annual tax for the purpose of paying interest and principal on the loan as they become due.
RESOLVED FURTHER, that no money obtained by the Town of Bayview by such loan from the state be applied or paid out for any purpose except refinancing outstanding debt without the consent of the Board of Commissioners of Public Lands.
RESOLVED FURTHER, that in case the Board of Commissioners of Public Lands of Wisconsin agrees to make the load, that the chairman and clerk of the Town of Bayview, in the County of Bayfield, Wisconsin, are authorized and empowered, in such form as required by the Commission, for any sum of money that may be loaned to the Town pursuant to this resolution. The chairman and clerk of the Town will perform all necessary actions to fully carry out the provisions of Chapter 24 Wisconsin Statutes, and these resolutions.
RESOLVED FURTHER, that this preamble and these resolutions and the aye and no vote by which they are adopted, be recorded, and the clerk of this Town forward this certified record, along with the application for the loan, to the Board of Commissioners of Public Lands of Wisconsin.
Supervisor Charly Ray moved adoption of the foregoing preamble and resolutions. Motion was seconded by Supervisor Larry Nelson. Roll call vote was taken – Al House aye, Charly Ray aye and Larry Nelson aye. Motion Carried.
Town of Bayview
Bayfield County Forest Stewardship funding was presented by Charly Ray. Possible projects would be rip rap on Little Sioux with pit run and cap with an estimated cost of $6,000-$10,000. Charly Ray will report back at next meeting.
Ordinance 12-02 to Extend Town Officer Terms in Response to Election Law Changes was read by Al House. Motion was made to approve Ordinance 12-02 was made by Charly Ray seconded by Larry Nelson. Motion carried.
Election Parking Ordinance will be presented at next town meeting. Motion was made by Charly Ray seconded by Larry Nelson to instruct Wanda Hyde to make a temporary sign for May 8th election. Motion carried.
Open Book is set for May 15th 2012 4-6 p.m. and Board of Review is set for May 15th 2012 6-8 p.m.
Next meeting is set for May 8th 2012 at 6:00 p.m.
