Special Meeting of the Town of Bayview
Friday, September 16th, 2011

Meeting was called to order by Chairman Al House at 10:04 a.m.

Roll Call:  Larry Nelson Supervisor, present; Charly Ray Supervisor, present; Al House Chairman, present and Wanda Hyde Clerk, present.  Others present:  Mike Yonan, Jim Maki; Marge Peterson, D. Scott Peterson and Joe Johanik.

Chairman Al House stated that this meeting was called regarding the recent survey done on Kjarvick Road by Nelson Surveying of Ashland.

Upper portion of Kjarvick was discussed.  Ditches and the roadway are right on according to Nelson’s survey.  There have been posts put in the ditch in preparation for fencing that have to be removed as they are encroaching on the highway right of way as well as a danger to snowplowing.

Motion by Charly Ray seconded by Larry Nelson that the clerk formulates a letter to the Peterson family regarding removal of the posts in the area from Potter Road to the first intersecting driveway by October 16th, 2011.  Motion carried.  It was decided that the clerk send letter to town attorney before sending to the Peterson’s.

Lower area fence of Peterson’s on Kjarvick was discussed.  That fence is on highway right of way as well. Noted that it has been there a long period of time and is not a hindrance to snow plowing.  Motion was made by Larry Nelson seconded by Charly Ray that the clerk formulate a letter to Peterson’s stating that the fence is in the road right of way and that this board recognizes that it has been there for awhile and would allow it to remain where it is as long as it hasn’t been a problem for snowplowing.  If at any time the fence requires significant maintenance and repair, the fence be relocated at that time.  This board does not wish to restrict any future town board from any action they may deem necessary.  Motion carried.   It was also noted that if property at any time changed hands fence would then be relocated behind road right of way.

It was brought to the town board’s attention that the surveying requested had not been completed on Kjarvick and Al House would call to request that they finish the job.

Motion to adjourn at 10:28 a.m. was made by Charly Ray seconded by Larry Nelson.
