Town of Bayview

June 10, 2025

Meeting was called to order at 6:02 p.m. by Chair Don Jenicek.

Roll Call:  Chair Don Jenicek; Supervisor Mike Garnich, present; Clerk Kim Suske, present; Treasurer Kelly Warren, present; Supervisor Bill Bodin, present at end of meeting via phone.

Others in attendance:  Guy Folsom, Paul Johnson, Mike Yonan, Butch Warren, Duane Potter, Mary Ross, Kim Ross.

Approval of Town Board Meeting Minutes from 05/13/2025:  Motion made by Mike Garnich to approve as written; seconded by Don Jenicek.  Motion carried.

Treasurer’s Report by Kelly Warren:  Checking $44,438.69; Equipment $6402.39; Room Tax $9542.88; Contingency Fund $ 24,552.56; and Tax Levy Savings $64,882.34.

Citizen’s Concerns and Comments: 

Concern expressed by a citizen on Kjarvick Rd. about gravel being put on driveway on Smith’s Fire Lane.  We are improving this for logging trucks.  Mike Yonan will look at it.

Citizen asked if we could hold off on calcium chloride application until after he is done haying.  We won’t be putting down calcium chloride until next week and he says he’ll be done haying before then so all is good.

Citizen commented that the Finn Settlement sign needs maintenance and perhaps a culvert near there to facilitate mowing.  Mike Yonan will put in a culvert so it can be mowed.

Norvado fiber optic update/service implementation:  Guy Folsom was here on behalf of Norvado.  Motion made by Mike Garnich to allow Norvado to place fiber optics cabinet next to Bayview Park Road; seconded by Don Jenicek.  Motion Carried.

Bayview History Committee request to add a boardwalk, switch, and story boards near depot—  Discussion and possible action:  Mike Garnich met with Paul Johnson.  This would all be a nice addition to the history committee’s current displays.  It would go to the right of the other building (as you are facing the lake) and completes their story.  Mike Garnich made a motion to approve the Bayview History Committee adding a boardwalk, switch, and story boards as indicated on their drawings that were shared at the May meeting; motion seconded by Don Jenicek.  Motion carried.

Petition to Bayfield County from Kevin and Amanda Roy to rezone property (Tax ID #7046) from AG-1 to R-3—Discussion and possible action on Town Board recommendation:  Much discussion was held about the pros and cons of rezoning vs. variance and what the various procedures are.  Mike Garnich made a motion to approve rezoning from AG-1 to R-3 with the stipulation that the Town would prefer that the landowner get a variance for reduced side yard setback; seconded by Don Jenicek.  Motion carried.  The Town Board Recommendation Form was completed and signed and the clerk will drop it off tomorrow with Bayfield County Planning and Zoning Department.

Proposal to redesignate Apostle Islands National Lakeshore as Apostle Islands National Park—Discussion and possible action:  Mike Garnich sent a letter to Tom Tiffany’s office asking if this is going forward—there is nothing about it on the website of the National Park Service or on Tom Tiffany’s office website.  Tiffany’s office did not reply.  Town is not going to take this up at this time.

Liquor license for 3T Enterprises dba Good Thyme Restaurant and Catering—Discussion and possible action:  Don Jenicek made a motion to approve 3T for alcohol beverage license for this year; seconded by Mike Garnich.  Motion carried.

Liquor license for Valhalla Pub and Grub—Discussion and possible action:  Don Jenicek made a motion to approve Valhalla for alcohol beverage license for this year; seconded by Mike Garnich.  Motion carried. 

Room Tax Committee member appointment—Discussion and possible action:  Mike Garnich made a motion to reappoint Jay Pringle to the room tax committee; seconded by Don Jenicek.  Motion carried.  Clerk will call Jay to make sure this is okay with him as he is not here today.

Picnic postcard discussion:  Postcard as presented by clerk was approved.

Houghton Falls Nature Preserve:  No updates from the courts.  Reinstall the donation container.

Potter Road maintenance—Discussion and possible action:  Potter Road needs grading.  Mike Garnich emailed Terry Peterson to let him know what would be going on and Terry was fine with it and will notify his family.

Road Crew mid-year pay review:  Tabled until next month.  Clerk will contact neighboring Towns and ask them to share their pay information.

Roads Report:  Starting to put down calcium chloride.  Need to bill County $1000 for CaCl on Whiting Rd.  Awaiting title for new water truck.  Bodin Road is done except for removal of poles/gravel work/straw in ditches.  They’ll start mowing soon.  Rebuilding the plow for the International truck.

Board Comments:  None.

Correspondence: 

Ron Shuga applied for a Land Use Permit through Bayfield County to add a new accessory building to his commercial property on STH 13.

Bayfield County sent a letter informing our Town that they now have “been delegated the authority to issue commercial electrical permits and perform such inspections for projects within your municipality.”

Clerk shared second notice of Salt Storage Facility Compliance Deficiencies letter from the WI Department of Transportation.

Bill Bodin has a letter from Mary Dougherty to give to Clerk.

Bill Bodin shared that he was unable to contact the STR owner who has stated the he will not fill out the quarterly room tax report form.

Payment of Bills:  Motion made by Mike Garnich to approve payment of Town bills from May 13, 2025 to June 10, 2025 in the amount of $35,143.59; seconded by Don Jenicek.  Motion carried.

Next Town of Bayview Regular Board meeting is set for July 8, 2025, at 6 p.m. 

Moton to adjourn was made by Don Jenicek; seconded by Mike Garnich.  Meeting adjourned at 7:41 p.m.
